Discussion: Cultural Heritage: Who Owns Art?
We’ve learned about historical context and how
important it is to understanding and interpreting a
work of art. As much as history is part of an
work’s meaning, so, too, is the art of a given
culture considered to be part of its collective
history. What we sometimes refer to as cultural
heritage includes the customs, places, and
objects of a culture. But who can claim ownership
of ‘cultural heritage’? Communities move from
place to place and most cultures were not
homogeneous, especially over hundreds of years.
Physical objects can easily pass over land from
one region to the next, just like they might pass
from one family member to a member the next
generation, get lost, stolen, or sold to someone
completed unrelated to the community in which
the object originated.
You may have never thought about how art gets
from one place – like Greece – to a museum in
another country – like the United Kingdom. But
when we look at some of the greatest museum

collections in the world, many of their objects
come from places outside their borders. How did
they get there? Who owns those objects,
technically, and should they? With the redrawing
of borders and the establishment of countries only
as recently as the late 18th and 19th centuries,
where can some of the most ancient objects
rightfully call home, if not the museum? Strict
laws regarding ownership and repatriation of
cultural objects made as late as 1970, meaning
that it is only within the last 50 years or so that
taking an object from one place to another without
proper paperwork could be considered illegal.
Can anyone, in reality, claim “ownership” of
ancient art?
Below, I’d like us to “discuss” as a class the topic
of the repatriation of (meaning return of) the
Parthenon sculptures, sometimes referred to as
the ‘Elgin marbles’. Please carefully read through
all the instructions below and complete this
