A woman is robbed, and immediately finds a police officer to whom she gives this description: male white, 20 years old, 5’10’, wearing a red t-shirt. She then gets into the patrol car and drives around. About 15 minutes later she sees a white man, about 25 years old, 5’7′, wearing a yellow Mickey Mouse sweatshirt. As the patrol car approaches she yells out, “That’s him! That’s him!” The officers get out of the car and tell the man to stop, As they come up to the man they ask where he was coming from. He says, “I just came from my brother’s house. I’m not saying anything else.” Do the police have enough probable cause to arrest this man? Why or why not? Discuss the difference between probable cause and sufficient evidence to convict after trial (proof beyond a reasonable doubt). Should the latter have a bearing on whether the police ought to arrest someone? Why or why not?
