Mental illness is a health condition that affects the mind and changes the way a person thinks, feels or acts. There are many different types of mental illnesses, for example, mood disorders, depression, bipolar disorder and schizophrenia. Some disorders can start at any time in your life. A great example of this is the mental health illness known as depression. A person who suffers from this disorder has difficulty enjoying things, they feel sad, hopeless, are unable to eat or sleep well and constantly feel tired. I use this example to show that because a person suffers from this mental disorder, it does mean they are incapable of deciding what treatment options they want or need.

According to “Mental Health America’s Position 22: Involuntary Mental Health Treatment” https://www.mhanational.org/issues/position-statement-22-involuntary-mental-health-treatment, they believe that “effective protection of human rights and the best hope for recovery from mental illness comes from access to voluntary mental health treatment and services that are comprehensive, community-based, recovery-oriented, and culturally and linguistically competent”. I cannot stress enough that preserving respect for what a patient prefers, needs and values ultimately promotes healthier patient outcomes. It is a basic principle of American law that all adults are presumed to be capable of making their own decisions about their own lives and their medical care, including mental health treatment. They are considered “competent”.

To force another person to receive involuntary treatment through coercion is a form of discrimination. Patrick Corrigan from the University of Chicago conducted an extensive study on how stigma interferes with mental health care. His findings and research suggest that “stigma may impede people from seeking or fully participating in mental health services”. Stigma leads to a person with mental illness to think less of themselves, to have lower self-esteem. It allows the negative attitudes of others to alter the way our mentally ill persons are perceived within society. These individuals are less likely to get a job, integrate themselves into society and participate in societal activities. Our legal system endorses the principle that all persons are competent to make reasoned decisions unless they demonstrate otherwise. Therefore, persons with mental health conditions deserve the same degree of personal autonomy, or self-governance, -similar to those with disabilities- when it comes to receiving services. The Mental Healthcare Act of 2017 (MHCA 2017), bluntly talks about patient rights with mental illness and sets forth the ethical and legal responsibilities of mental health professionals and the government stating: “Such rights translate into the ethics of psychiatric care that relate to respect for autonomy; the principle of non-maleficence, beneficence, and justice; confidentiality (and disclosure); boundary violations; informed consent (and involuntary treatment)”. https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6436399/.
