Juveniles in the country face various challenges when it comes to the court or justice
system. Many people argue that juveniles should receive a similar trial or sentencing as
adults. On the other hand, other experts argue that subjecting the juveniles to such systems
and procedures may lead to unfair trials based on high standards that they may not always
meet. The primary aim of this paper revolves around providing an argument that goes against
the inclusion of juveniles in adult trials in the country. Juvenile offenders should not be tried
as adults because youth are still irrational in their thought process, their brains have not fully
developed and rehabilitationis not going to structured to curb behaviors where they can be
productive citizens of the future.
According to Daugherty, (2015), the available criminal justice laws lack the aspect of
considering the affairs and interests of the youth offenders first as opposed to those that serve
the adults. The laws, in this case, present a gap which fails to consider issues such as
rehabilitation on the youth offenders and instead present them with a legal framework of
punishments. The author claims that the youths who were tried using the adult systems and
laws exhibited 3.4% of rearrest. Additionally, the author claims that youth offenders
subjected to adult systems in most cases may exhibit dangerous levels of mental disturbances.
These issues affect their abilities to interact with the rest in the community as well as
increasing their exposure to violence through such sentences.
On the other hand, Scialabba, (2016) argued that juveniles should not be subjected to
the adult systems. The author in this case presents a scenario where a young boy aged 14
years got arrested in New Mexico. The primary reason behind the arrest of the young boy
came from the notion that he had thrown a rock at law enforcement officers during a public
rally in the mentioned area. According to the law enforcement officers, they would subject
the young boy to adult trial claiming that it would not make an example of him. The police
officers responsible in the context claimed that such a trial would assist the stakeholders in

shaping the behavior of the offender. On the other hand, the attorney representing the boy
disregarded the claims made by the police saying that such actions would, in the end, damage
the boy`s future. This scenario shows that subjecting the boy to juvenile trial would reduce
the cases of adult punishments and increase the abilities of the offender to receive the
required levels of rehabilitation.
Conclusion
Summing up, rehabilitation acts as one of the goals that the juvenile system operates
under. The primary reason for the establishment of the juvenile system came from the desire
to prevent young offenders from being tried as adults, which would damage their lives at a
tender age. The punishments offered to adult offenders may not bring similar impacts on
young offenders. The authors mentioned above claim that youth offender should not be tried
as adults and hence should be subjected to a juvenile system which supports more of
rehabilitation and less of punishments to the offenders.
